After the New York County Supreme Court dismissed his claim, Ricky appealed to Appellate Division, First Department.

Since he couldn't prove he ever received a fully executed version of the document, or produce a "true and accurate" copy, Ricky wasn't able to show that a binding and enforceable agreement existed.
