Florencia Amaya was sued after her car, operated by a man she didn't know, was involved in a head-on collision. When she later asked that the case be dismissed, the Suffolk County Supreme Court denied her request.
Since Florencia had loaned the car to Ever Benitez, with the understanding that no one else was allowed to drive it, and, the guy involved in the accident didn't have Florencia's or Ever's express or implied consent to operate the vehicle, the Appellate Division, Second Department, reversed and let the lady out of the case.
Bet she won't Ever do that again.
