SCHOOL DAZE

Plainview-Old Bethpage Central School District was sued by Mark Faraci, on behalf of his son, Jake, after the kid was attacked by a fellow student on school grounds.

While Mark claimed there wasn't enough supervision, the School District countered that it was free of liability because the attack wasn't predictable. And when the Nassau County Supreme Court sided with the Faracis, the School District appealed.

Although there's a duty to provide students with appropriate security and supervision, there can be no responsibility for injuries unless school officials are aware of a threat or the possibility of harm. Because this particular attack was random, the Appellate Division, Second Department, gave the School District a pass.
