While walking on a sidewalk, Bayron Gonzalez was hit by a van that was being pursued by a police vehicle.
When he later sued the Nassau County Police Department for the injuries he sustained, the Nassau County Supreme Court refused to let the cops out of the case.
Because the officers were in pursuit of a driver who had broken a number of traffic laws, the Appellate Division, Second Department, thought the situation constituted an "emergency" which exempted those particular defendants from legal responsibility. (Since liability could only attach if the cops acted with "reckless disregard for the safety of others," and that wasn't shown to be the case, the AD2 let the officers off scot-free.)
They sure cut to the chase there.
