BRIDGE OVER TROUBLED WATER

bridge_girders_photo_nyreblog_com_.JPGWhile he was driving on the lower roadway of the Queensboro Bridge, Zamil Uddin lost control of his car and hit a divider.

Uddin later sued the City of New York claiming that the crash was attributable to paint removal work which had caused a metal object to fall onto his vehicle. And after the New York County Supreme Court found the City free of any liability, Uddin appealed.

Because City employees weren't working on the bridge at the time of the accident, the Appellate Division, First Department, agreed that the City wasn't negligent. (It didn't help the guy's case that another contractor--who wasn't joined as a party to the lawsuit--was doing "abrasive blasting" work in the same area.)

That was no accident.
