After they attacked and seriously injured a man, who had posted photographs which identified them as registered sex-offenders, W. Meacham and friends were found guilty of gang assault in the first degree by a Seneca County Court jury.
On appeal, Meacham claimed the evidence neither supported the outcome nor established that he meant to cause serious injury, but the Appellate Division, Fourth Department, didn't agree. It thought that Meacham intended to hurt the guy, as that was the "natural and probable consequences of repeatedly striking" a defenseless man.
And, since at least two other people were involved in the act's commission, the AD4 thought that the statutory basis for a conviction had been established.
