After filing a medical malpractice claim against New York Methodist Hospital, Gregory Borruso passed away.
Some eight years later, when the Kings County Supreme Court granted the hospital's request to have the case dismissed, Barbara Borruso (Gregory's wife) appealed.
Because no estate representative had been substituted in the decedent's place and stead since his death, the Appellate Division, Second Department, agreed that that lengthy period of inaction was "unreasonable" and allowed the dismissal to stand--even in the face of an attorney's professed "law office failure."
That sure was deadly.
