TOO SPICY?

cinnamon_photo_nyrebog_com_.JPGWhile on duty, police officer George Politis tripped and fell in a pothole on Cinnamon Street in Central Islip and later sued for damages claiming the Town had failed to maintain the street in a safe manner.

When the Town sought to have the case thrown out--because it had no written notice of the condition, as required by local law--the Suffolk County Supreme Court granted that request.

Since the evidence established that the Town had received no written notice of a defective condition, the Appellate Division, Second Department, affirmed. (Telephone complaints the Town might have received didn't satisfy the law's written-notice requirements.)
