Because he owed $6,292.43 in back rent, a judgment was entered against Todd Bank. When he later sought to vacate that outcome, claiming that he had paid the amount found to be due, the tenant sent the judge a copy of a personal check which had supposedly been forwarded to the landlord.
When the Queens County Civil Court denied his request for relief, Bank appealed.
Because he waited until after the trial to remit payment, the Appellate Term, Second Department, thought Bank's tender was a bit late. (It also didn't think the Civil Court was required to accept the tenant's check as evidence of payment, since there was no proof it was actually sent to the landlord.)
There was no Banking on that.
