DAMAGES ARE SUCH A PAIN

iron_photo_nyreblog_com_.JPGMichael Vukovich--a steamfitter--was working on a ladder when the nape of his neck touched an uncapped, live electrical wire. After falling and injuring his head, neck and back, Michael sued ADCO Electrical Corp. (and others) for his injuries.

When the jury awarded the guy $1,661,000 for future pain and suffering, and $2,103,249 in future lost wages, the New York County Supreme Court reduced that recovery to a total of $2,000,000.

Upon its review of the case, the Appellate Division, First Department, thought that Vukovich's recovery time had been minimized by the surgeries he had received and agreed with the lower court's damage calculations. (It was of the view the jury's verdict was inflated and "deviated from reasonable compensation under the circumstance.")

The guy must have been steaming.
