While Michael Petrosillo was picnicking at Crab Meadow Beach, he was asked by Jennifer Kelly, a volunteer, to help lift several bags of garbage.
As he rested one of the bags on the ground, a sharp object protruded from the debris and cut the poor guy's legs.
After the Suffolk County Supreme Court denied the Town of Huntington's request to dismiss the personal-injury case, the Town appealed.
Since the Town wasn't liable for its employee's "discretionary acts," the Appellate Division, Second Department, ended the case.
That good deed sure got punished.
