FAST AND FURIOUS

ambulance_photo_nyreblog_com_.jpgJoseph Woodward filed suit after he was involved in an accident with one of Associated Ambulance Service's vehicles.

Because a sick person was being transported, the ambulance driver was shielded from liability unless "reckless disregard"--or unreasonable behavior--could be shown.

Since the emergency lights and siren had been activated, and the driver had reduced speed and looked both ways before entering the intersection, both the Kings County Supreme Court and the Appellate Division, Second Department, were of the view that immunity applied and that the case had to be dismissed.

That had to be a pain in the AAS.
