00400607.jpgWhile driving a car owned by Cheryl Holt, Jamille Andrews crashed into the Campbell family.

Andrews later admitted that she intended to hit the Campbells, and pled guilty to three counts of assault in the second degree.

After they were denied coverage under Holt's auto policy (because the incident wasn't an accident), the Campbells then sought uninsured motorist benefits under their mom's policy.

When that insurer denied coverage, the Campbells asked for arbitration, which the company sought to enjoin.

Although that stay request was denied by the Orange County Supreme Court, the Appellate Division, Second Department, thought the Campbells weren't entitled to relief because their injuries were the result of an intentional criminal act and Holt's vehicle hadn't been "uninsured."
