After ten-year old Lauryn H. testified that her father, William A., sexually abused her, the Kings County Family Court granted custody of the kid to her mom and also removed the other child living with William.
On appeal, the Appellate Division, Second Department, thought Lauryn's testimony was reliable given her detailed account of the abuse and her unwavering position on cross-examination.
The evidence of sexual abuse was also strong enough to establish that William suffered from "impaired parental judgment" and was an unfit parent when it came to the other youngster in his care.
