After they got into a parking lot accident, Yermiahu Mazayoff sued Maryann Collins for damaging his vehicle.
Although the duo gave conflicting accounts as to what occurred, the Nassau County District Court judge thought the evidence supported Collins's version of the facts and dismissed the case.
On appeal, the Appellate Term, Second Department, thought that a trial judge's credibility determinations should be given deference unless the outcome was completely contradicted by the record.
Since the end result was consistent with a "fair interpretation of the evidence," and "substantial justice in this small claims case" had been served, the AT2 affirmed.
