Although the City of Beacon conceded that it overtaxed some of its property owners, it refused to refund any of the overpayments.
When Matteawan On Main, Inc. filed suit, the Dutchess County Supreme Court dismissed the case because it hadn't been timely filed (as required by the Beacon City Charter).
Since the one-year statute of limitations didn't apply to a tax overpayment, the Appellate Division, Second Department, reversed and sent the case back for further consideration.
