Vincent Gigliotti was supposedly fired from his job with the Niagara Falls School District because he didn't live in the area. But, in actuality, Gigliotti lived with his mom in Niagara Falls even after he got married. (A Niagara Falls address appeared on the guy's driver's license, bank statements, social security card, and vehicle registration.)
When he filed an administrative proceeding--pursuant to CPLR Article 78-- to have the School District's determination annulled, the Erie County Supreme Court granted his request.
On appeal, the Appellate Division, Fourth Department, agreed that the evidence unequivocally established Gigliotti was a lifelong resident of Niagara Falls, and that his wife's residence wasn't his domicile. As a result, the School District's actions were found to be "arbitrary and capricious," and its determination properly vacated.
Looks like he survived them Falls!
