TUFF LOVE?

wrench_pipe_photo_nyreblog_com_.JPGAfter he was robbed at gunpoint while using his building's stairwell, Robert Perez sued the property's owner, Real Tuff Piping & Heating, Inc., for failing to provide adequate security.

Although the landlord's dismissal request was granted by the Kings County Supreme Court, the Appellate Division, Second Department, didn't agree with that outcome.

Since Real Tuff knew the front-door didn't work, and that a burglary had previously occurred in the building, the AD2 thought Perez's incident was "foreseeable" and opted to reverse and reinstate the case.

Who's the boss now?
