THE RESULTS ARE IN

When the judge refused to vacate the verdict based on that denial, Eng appealed.

The Appellate Term, Second Department, agreed that a litigant has an "absolute" right to speak to the jury at the end of the case. Because the judge's error was seen as prejudicial, the dispute was sent back for a do-over.
