George Valentin's 4-month-old son suffered a hematoma and bilateral retinal hemorrhaging after an alleged beating.
When the Broome County Court convicted him of assault in the first degree, and sentenced him to 12 years (with 5 years of post-release supervision), Valentin appealed to the Appellate Division, Third Department.
Although Valentin was repentant, due to the severity of the misconduct, the AD3 didn't view the sentence imposed as either harsh or excessive nor did it find any "extraordinary circumstances" which warranted a reduction.
Valentin must have been heartbroken.
