After Jarees Johnson pled guilty to possession of a weapon in the third degree, the Erie County Court sentenced him to an indeterminate term of two to four years.
Claiming the sentence was "illegal," because it exceeded the permissible range, Johnson appealed to the Appellate Division, Fourth Department, which agreed with Johnson's arguments and sent the case back for resentencing.
Johnson must be Fuller himself.
