Elisa Rubinson's landlord filed an eviction proceeding against her claiming that she was a "nuisance" because she allowed gas to leak from her stove and had caused a fire in her apartment.
After the New York County Civil Court found her misconduct was sufficient to warrant her removal from the building, Elisa appealed.
Because her "repeated" actions "seriously threatened" the health and safety of the building's occupants and staff, the Appellate Term, First Department, thought Elisa had to go.
