00403613.jpgStuart Sugarman filed a negligence case against Equinox Fitness Club after a fellow customer, enraged by Sugarman's refusal to stop shouting and cheering during a spin class, pushed Sugarman and his cycle into a wall, causing neck and head injuries.

After the New York County Supreme Court granted Equinox's request to end the case, Sugarman appealed.

Because the attack was "unforeseeable and unexpected," the Appellate Division, First Department, agreed that liability on the fitness club's part couldn't be established.
