While Zong Mou Zou was working at a construction site, some sheet-metal decking gave way and caused him to fall some 14 feet to the building's basement.
When he later filed suit claiming Labor Law violations, the Kings County Supreme Court denied relief in his favor.
In view of the construction company's failure to provide adequate safety equipment, and since there was no evidence that Zong was somehow responsible for what occurred, the Appellate Division, Second Department, reversed and found in the guy's favor.
