When the New York City Housing Authority ("NYCHA") refused to place him on the waiting list for the Section 8 housing assistance program, T. Boddie filed a special proceeding -- pursuant to CPLR Article 78 -- with the New York County Supreme Court.
After he was found ineligible for Section 8, Boddie appealed to the Appellate Division, First Department.
As a registered sex offender, Boddie was not only ineligible for the Section 8 program, but for public housing in general.
