In the context of an "objectionable conduct" holdover case, St. Margaret's House entered into an agreement which allowed a tenant him to remain in possession of his residential space provided that wouldn't "verbally or physically assault" or "stalk or harass" any person in or around the building, and, "socialized" with others in a "peaceable manner."
If the guy violated any of those terms within a two-year period, St. Margaret's could seek the his immediate eviction.
When the tenant later punched a visitor in the face and verbally abused at least three people, the New York County Civil Court granted St. Margaret's request to have man the evicted and, on appeal, and the Appellate Term, First Department, affirmed.
Looks like the AT1 sure punched that one out.
