After he was convicted by the Monroe County Supreme Court of assault in the third degree, Luis Mateo went to the Appellate Division, Fourth Department, claiming that he lacked the requisite criminal intent.
Although he had consumed a bit of alcohol on the night in question, the AD4 was of the view the record supported the conclusion that Mateo was aware of the nature of his misconduct and affirmed the conviction -- particularly since it was the jury's role to determine whether the guy's mental state somehow excused his actions.
