Judith Rosenfeld was hit by a high-flying baseball while attending a minor-league baseball game and later sued the stadium's architects, owners, and the "Hudson Valley Renegades."
After the Dutchess County Supreme Court dismissed her case, Rosenfeld appealed to the Appellate Division, Second Department.
While the area behind home plate can pose a considerable danger to spectators, no liability for injuries will attach when appropriate screening is provided.
In this particular instance, since Rosenfeld never claimed to have been situated behind home plate, nor asserted that her area wasn't properly screened, the poor lady struck out.
