Biography

Thomas P. Phelan, born in Brooklyn and raised in Oceanside, is a graduate of Stony Brook University with a Bachelor of Arts degree. He earned his Juris Doctor degree from New York Law School. Justice Phelan is admitted to practice law in New York and Florida. 
A Supreme Court Justice since 1996, Justice Phelan is seeking reelection on November 3, 2009.
After serving as an Assistant District Attorney, he became Principal Law Clerk to a Supreme Court Justice and Nassau County Court Judge.  Justice Phelan remained a Principal Law Clerk  until June 1984, when he left government employment to engage in the private practice of law, specifically civil and criminal litigation as well as Surrogate's Court practice.  Justice Phelan also served as a member of the Public Employees Relations Board of the Town of Hempstead until his appointment as a Judge of the District Court, Nassau County, in January 1991.  He was elected to the District Court, Nassau County, Second District, in November 1991.  After five years as a District Court Judge, Justice Phelan won election to the New York State Supreme Court in 1996.

In his judicial career, Justice Phelan has had more than 100 decisions  published in the Official Reports, N.Y. Law Journal and other prominent legal publications.
