In Vida v. Yorktown Highway Dept ., Antonio Vida sued to recover $1,300 when his truck and fence were supposedly damaged by a Yorktown Highway Department snow plow.
Since Vida wasn't present when the incident took place, and didn't have any evidence supporting his claim, the Justice Court of the Town of Cortlandt Manor dismissed his case.
Because it wasn't clear who damaged Vida's property, the Appellate Term, Second Department, refused to the disturb that outcome on appeal.
