j0438744.jpgAfter leaving a social event with his three sons and their friend, Ahmed Abdel-Gawad couldn't start his car.

Ahmed directed the four kids to exit the vehicle and push it down the street while he steered. Everyone except Ramy, Ahmed's 15-year old son, complied. After that youngster later acquiesced to his father instructions, Ahmed ran over the poor Ramy's foot and ankle.

When Ramy later sued his Dad to recover damages for his injuries, Ahmed asked for the case's dismissal on the grounds that a child isn't permitted to sue a parent for "negligent supervision." After the Suffolk County Supreme Court denied his request, Ahmed appealed to the Appellate Division, Second Department.

Since it found the case to have been based upon the negligent operation of a vehicle, rather than on negligent parental supervision, the AD2 allowed Ramy's case to roll on.

Ramy put his best foot forward there.
