Esther Goldman filed an administrative proceeding -- pursuant to CPLR Article 78 -- when the New York City Housing Authority opted to evict her from the unit she allegedly lived in with a public housing tenant.
After the New York County Supreme Court upheld the eviction, Goldman appealed to the Appellate Division, First Department, which unanimously affirmed.
The AD1 thought Goldman lacked an entitlement to stay in the unit as she wasn't related to the deceased tenant nor proffered any other cognizable legal basis to remain in possession.
