In Matter of Sebastian M. v. Lizette M. , the Commissioner of Social Services sought to end Lizette M.'s parental rights and place her kids in foster care.
Because the evidence established Lizette was "mentally ill," and wouldn't recover from her affliction in the "foreseeable future," the New York County Family Court granted custody of her children to Social Services for adoption.
On appeal, the Appellate Division, First Department, agreed that Lizette wasn't able to "properly and adequately" care for her children. (Although given an opportunity to do so, Lizettte failed to counter the expert testimony or establish that she was complying her treatment regimen.)
A prescription for disaster.
