STORMY WEATHER

j0438800.jpgRamona Coleman sued Jacqueline Lorusso (and others) after slipping and falling on an icy sidewalk.

While Coleman claimed she fell on ice, she couldn't describe the conditions which existed nor observed any ice prior to her fall.

After the Erie County Supreme Court granted the defendants' request to dismiss the case, Coleman appealed to the Appellate Division, Fourth Department.

Since she was unable to show that the ice was in place for a sufficient period of time, and that the defendants had sufficient notice of the dangerous condition, the AD4 allowed the dismissal to stand.

Don't know why....
