After he was hit by a vehicle owned and operated by members of the Fanto family, Ronald Spanos claimed to suffer from pain in his right hip, leg, and lower back. Interestingly, the Fantos submitted evidence showing that Ronald's alleged physical state was due to preexisting conditions.
When the Monroe County Supreme Court denied the Fanto family's request to dismiss the case, an appeal to the Appellant Division, Fourth Department, followed.
Since Ronald wasn't able to show that the accident caused his injuries, and couldn't establish an entitlement to damages, the AD4 reversed and dismissed the case.
That had to hurt.
