When the New York County Supreme Court found the NYC Transit Authority (NYCTA) liable for Saundra Crane's injuries, NYCTA appealed to the Appellate Division, First Department.
Crane was riding a NYC bus when it came to an abrupt and "violent" stop, causing her to suffer a "head injury and broken clavicle."
Faced with those facts, the AD1 found Crane established a "prima facie case of negligence." Without adequate evidence in the record, it didn't buy NYCTA 's argument the brake had been triggered by a passenger who was pushing open the rear door.
Crane didn't need that brake.
