In Gonzalez v. State of New York , Mary Gonzalez sued New York State for injuries she sustained after she fell down two wooden steps at the Greene Correctional Facility.
Gonzalez claimed the State created a dangerous condition because there was no handrail and the nose board was uneven.
After the Court of Claims dismissed her case, Gonzalez appealed to Appellate Division, Third Department.
While the sloping nose board was a building code violation, that didn't warrant relief in Gonzalez's favor since the AD3 neither viewed the condition as "dangerous" nor found the lack of a handrail to have been the cause of her fall.
No correcting that.
