DISCOURTEOUS COP?

I-84_nyreblog_com.pngIn Matter of Revella v. Felton , off-duty officer Christine Revella and her husband were cruising down I-84 when they were passed by a white Camry which was allegedly driven "erratically" by Dana Sano.

Revella flashed her lights at Sano's car and followed the vehicle to a toll area where Sano supposedly flipped Revella's husband "the bird." In response, the latter exited the car and yelled for Sano to stop. When she refused to do so, the couple pursued Sano to a hotel, where she was supposedly threatened with arrest. (All the while, Revella supposedly failed to identify herself as an officer.)

After Revella was found guilty of three violations of State Police regulations, including "failure to assume responsibility or exercise due diligence in performing her duties," bringing "discredit upon the State Police," and "failing to act in a courteous, dignified and businesslike manner," a Hearing Board recommended probation, but the Acting Superintendent of the State Police demoted Revella to the rank of sergeant.

On appeal -- pursuant to CPLR Article 78 -- the Appellate Division, Third Department, found the evidence supported the outcome and agreed Revella was guilty of misconduct. It also didn't view her demotion as "shocking to [its] sense of fairness."

No reveling in that.
