Laurence Costello slipped on a wet floor in a building owned by Yitty and Samuel Zaidman.
After Costello's personal-injury suit was filed with the Kings County Supreme Court, the Zaidmans -- along with others -- asked for the case's dismissal. When that request was denied, an appeal to the Appellate Division, Second Department, followed.
Since the owners neither created nor had notice of the condition which supposedly caused the incident to occur, the AD2 was of the view Costello's case couldn't continue and granted relief in the defendants' favor.
