After Spindell was convicted by a New York County Criminal Court jury of aggravated harassment and harassment in the second degree, an appeal to the Appellate Term, First Department, was filed.
The AT1 was of the view the jury's verdict was supported by the "weight of the evidence."
The jury heard Spindell's "threatening and abusive" recordings and properly concluded the "vile and vitriolic" messages were intended "to cause annoyance or alarm," and didn't comprise constitutionally protected speech.
That's some disconnect!
