In the Matter of Booth v. New York State Dept. of Corrections , Troy Booth, an off-duty correction officer was was gearing up for the "Department of Correction Olympics" -- an annual state-wide baseketball competition -- and was injured while practicing at the prison where he was employed.
When Booth sought worker's compensation coverage for the injury, a Worker's Compensation Law Judge denied that request because the accident didn't occur at an employer sponsored event.
After the Worker's Compensation Board affirmed that decision, the officer appealed to the Appellate Division, Third Department.
Since the activity wasn't sanctioned by his employer, and was controlled and organized by the officers themselves, the AD3 was of the view Booth didn't qualify for any benefits.
