In Matter of Dante B. , Dante was found by the Bronx County Family Court to be a juvenile delinquent for an act which, if committed by an adult, would have constituted criminal possession of a weapon.
After hearing gun shots, the arresting police officer found Dante in "close temporal and spatial proximity" to the gunfire and observed him adjusting a "bulge" in his waistband -- which suggested the kid was carrying a weapon.
Given those circumstances, the Appellate Division, First Department, was of the view the officer had an adequate basis to conduct a patdown of Dante's "bulge area."
That was quite fiery.
"All hope abandon, ye who enter in."
