SNOW FALL LEADS TO INJURY

j0422147.jpgClaudia Taylor slipped and fell down a flight of stairs, allegedly due to excessive moisture in the building's foyer. (Two hours before Taylor arrived at the building, a snowstorm had just ended leaving five inches of snow on the ground and an unshoveled pathway to the building.)

After Taylor sued the building owner, Leslie Jaslove, in Kings County Supreme Court, Jaslove asked for the case's dismissal. When that request was denied, Jaslove appealed to the Appellate Division, Second Department.

Since Jaslove established he neither created the alleged hazardous condition, nor had any notice of its existence, and, because he also submitted proof he hadn't received any complaints regarding condensation in the foyer, nor seen any water accumulation, the AD2 thought ending the litigation was appropriate.

With that, the case dried up real fast.
