In Matter of Batts v. Fischer , inmate Javares Batts was charged with possession of contraband.
Although Batts's cell was searched prior to his entry, and passed inspection, prison officials later found a "green leafy substance" which proved to be marijuana.
During a Tier III hearing, Batts argued the drugs weren't his and that prison guards had planted them in his cell. Unpersuaded, prison officials found Batts guilty of possession and imposed a penalty.
On appeal, the Albany County Supreme Court transferred the case to the Appellate Division, Third Department, which was of the view the evidence against Batts supported the outcome.
That Batts struck out!
