j0437195.jpgAfter his car slid off County Route 3, Noah H. Friedland sued Warren County claiming the accident was caused by the local government's failure to remove a snow and ice buildup.

Since the County didn't have notice of the dangerous road condition, the Warren County Supreme Court dismissed the case. On appeal, the Appellate Division, Third Department, was equally unreceptive to Noah's claim.

Because the County presented sufficient evidence it didn't know of any perils, and Noah neither raised a question of fact nor an exception to the governing notice requirement, the AD3 allowed the lower court's decision to stand.

Bet Noah doesn't know what hit him.
