In Sanchez v. Kelly , Jose Sanchez, a Sergeant of the New York City Police Department, contested the Police Commissioner's recommendation that 20 vacation days be forefeited.
Since the challenge was based on the substantiality of the evidence presented at an administrative hearing, the New York County Supreme Court transferred the case to the Appellate Division, First Department, which confirmed the outcome.
According to the AD1, the punishment was appropriate given that Sanchez had encountered two on-duty, uniformed, intoxicated detectives, "failed to supervise" them, and, didn't file a required "Fitness for Duty Report."
