TRYING TOO HARD TO BE LIKE MIKE?

j0414105.jpgIn Milliner v. New York City Hous. Authority , Brandon Milliner sued the NYC Housing Authority (NYCHA) after slipping and falling on an outdoor basketball court.

When the Bronx County Supreme Court dismissed his case, Brandon appealed to the Appellate Division, First Department.

 

The AD1 was of the view Brandon "assumed the risks" which are part of "playing hoops." It also didn't help he was an experienced player who was familiar with the court's "surface and its depressions."

 

(Prior to his injury, Brandon had been playing on the court for over an hour and and conceded he had been aware of a puddle's existence.)

 

Must have thought he was Aquaman .
