NO PRISON BREAK

j0422480.jpgEfrain Suarez, a prison inmate, sued the State of New York claiming prison personnel were negligent in failing to address problems with his bed and that their unwillingness to address the situation -- and to attend to his medical needs after his fall -- violated his "civil rights."

When the Court of Claims granted the State's dismissal request, Suarez appealed to the Appellate Division, Third Department, which affirmed the lower court's decision.

Apparently, Suarez was unable to show the State was responsible for his injuries. (Suarez couldn't show that he -- or someone else -- hadn't caused the mishap.)

Looks like the poor guy took yet another fall.
