
While her medical reports showed that she suffered from a limited range of motion in parts of her spine, there was no evidence this limitation stemmed from the crash. (In fact, her expert's failure to comment on a doctor's findings, that Torres suffered from a minor degenerative spinal disease, didn't help at all.)
When the Civil Court dismissed her case (on the grounds her injuries weren't "serious" and didn't prevent her from performing her "usual and customary activities"), she appealed to the Appellate Term, Second Department, which affirmed the outcome.
