j0428528.jpgEmma Hanley, a "J" train passenger, was injured in a collision on the Williamsburg Bridge.

Since the New York City Transit Authority (NYCTA) conceded liability for the accident, the only remaining issue was the amount of her damages and a jury ultimately awarded Hanley $1 million for past pain and suffering.

After the Kings County Civil Court granted the NYCTA's request to set aside the verdict and ordered a new trial, Hanley appealed to the Appellate Term, Second Department.

Considering the nature and extent of Hanley's injuries, the AT2 thought that the jury's award "deviated materially" from what was reasonable and reduced her recovery to $100,000. And If she refused to accept that lower sum, the case needed to be retried.
